Construction Sector: Companies are obliged to register in the Register of Accredited Companies

Every national or foreign company, that enters or participates in the construction sector in Spain, has to comply with certain specific obligations; otherwise the Spanish Labour Authorities could impose penalties.

All companies, both national and foreign, that act as contractors or subcontractors in the Spanish construction sector have to comply with specific requirements and obligations. One of the most important requirements is the prior and mandatory registration in the Register of Accredited Companies (known in Spanish as “REA”). This is considered as a sine qua non requirement for any company that wishes to participate in any construction work or project.

By means of registration in the REA Register, companies ensure that their internal organizational structure is as required and that they have adequate infrastructure and adequate human and material resources. 

Companies also have to certify that the employees who render their services in the construction sector have received specific training regarding the rules on prevention of occupational risks, and they have to demonstrate that the company has appropriate preventive organization in place regarding prevention of occupational risks.  

Registration has a validity period of three years and is renewable for equal periods, at the end of any period and in case renewal is not requested in time, the Spanish Authorities automatically cancel the REA registration.

 

The Spanish Labour Authorities can impose different sanctions or penalties on those companies that do not comply with their obligations. The lack of accreditation of employees’ training regarding risk prevention, or of adequate preventive organization, or the failure to comply with the obligation of registration in the REA are considered under Spanish law as serious breaches. In such cases the competent Authority in Spain could impose penalties of between 2.000€ and 40.000€.
