General Terms and Conditions for Events
1. Scope of Application
1.1. These General Terms and Conditions for Events (hereinafter referred to as the ‘Terms and Conditions of Participation’) govern the contractual relationship between the company within the RÖDL Group named as the organizer in the relevant event description (hereinafter referred to as the ‘Organizer’ or ‘RÖDL’), and the company participating in the event within the meaning of Section 14 of the German Civil Code (Bürgerliches Gesetzbuch; BGB), a body or institution governed by public law, or a special fund under public law (hereinafter referred to collectively as ‘Participants’). Services are not provided to consumers within the meaning of Section 13 of the German Civil Code (BGB).
1.2. These Terms and Conditions of Participation apply to both free and paid events organized by the Organizer on-site in person, online via the internet or in a hybrid format.
1.3. These Terms and Conditions of Participation apply exclusively, unless expressly provided otherwise in the following provisions. Any conflicting, deviating, or supplementary provisions of the Participant shall not apply, even if RÖDL does not object to them.
2. Registration, conclusion of contract
2.1. Registration for an event takes place via the online registration form, unless alternative registration options are expressly listed in the event description.
2.2. By registering for the event, the participant submits an offer to participate. A contract for participation shall only be concluded upon acceptance of the offer by RÖDL. Confirmation of receipt of the registration does not constitute acceptance of the contract. Acceptance is effected by a registration confirmation, which is sent to the participant via email within seven business days.
2.3. For events with limited capacity, registrations will be considered in the order in which they are received. If the maximum number of participants for an event is reached, registration for that event will no longer be possible, unless a spot becomes available due to another participant’s cancellation.
3. Participation fee
3.1. For events subject to a fee, the participant is obligated to pay the stated participation fee. The amount of the participation fee is specified in the respective event description. Unless otherwise stated, participation fees are per person and per event date, plus statutory VAT.
3.2. Payment of the participation fee is generally made after the event, upon receipt of an invoice. The invoice is due within 14 days of receipt, without any deductions.
3.3. Travel, accommodation, meals and other costs are not included in the participation fee and must be paid by the participant, unless otherwise agreed.
4. Withdrawal
4.1. The participant has the right to withdraw from a completed registration without giving any reason. Notice of withdrawal must be given in writing at the very least.
4.2. In the event of cancellation of a paid event up to 14 days before the event begins, no cancellation fee will be charged. In the event of later cancellations or a no-show, the full participation fee will be charged.
4.3. If the event is offered free of charge, participation may be canceled at any time without charge. Please notify us accordingly.
5. Program, changes and cancellations
5.1. The details, schedule and further information regarding an event can be found in the respective event description.
5.2. We reserve the right to make necessary program changes, e.g. in the event of a speaker’s illness or due to current circumstances. RÖDL will notify you of such changes as early as possible.
5.3. Should a speaker be unable to attend or should the minimum number of participants, to be determined by the organizer, not be reached before the event date, RÖDL reserves the right to cancel the event. The same applies in cases of force majeure, such as strikes or natural disasters, or in the event of other circumstances that make it impossible to hold the event on the announced date(s). In such cases, RÖDL will notify you as soon as possible.
5.4. In the event of cancellation, RÖDL will refund any participation fees that have been paid. Any further claims for damages, in particular for travel and accommodation costs, are excluded, unless the cancellation of the event is due to gross negligence or willful misconduct on the part of RÖDL.
6. Liability
6.1. RÖDL shall be liable without limitation in cases of willful misconduct or gross negligence.
6.2. In cases of slight negligence, RÖDL bears unlimited liability in the event of injury to life, limb or health.
6.3. In all other cases, RÖDL shall only be liable to the extent that a material contractual obligation has been breached. Material contractual obligations are defined, in abstract terms, as those obligations whose fulfilment is essential for the proper performance of the contract and on the observance of which the participant may reasonably rely. In such cases, liability is limited to compensation for foreseeable, typically occurring damage.
6.4. Liability under the Product Liability Act remains unaffected.
6.5. To the extent that RÖDL’s liability is excluded or limited in accordance with the aforementioned provisions, this shall also apply in favor of RÖDL’s legal representatives, employees, and vicarious agents.
7. Data Protection
Personal data will be processed for the purpose of organizing the event. Information on how we process your data can be found in the privacy notice for events.
8. Copyright
8.1. The content made available as part of the event is protected by copyright and is intended solely for the participant’s personal use.
8.2. Reproduction, distribution or any other use of the content is permitted only with the express consent of the copyright holder.
9. Rules of conduct
9.1. Participants agree not to disrupt the event and to respect the rights of other participants.
9.2. For in-person events held on-site, participants must comply with the venue’s rules and regulations while on the event premises.
9.3. In the event of violations of the rules of conduct, the participant may be excluded from further participation in the event. Any further claims by the organizer against the participant remain unaffected.
10. Final Provisions
10.1. There are no verbal side agreements. Any amendments or additions to these Terms and Conditions of Participation must be made in writing to be effective. This also applies to any waiver of the written form requirement itself.
10.2. Should one or more provisions of these Terms and Conditions of Participation be or become invalid or unenforceable, in whole or in part, this shall not affect the validity of these Terms and Conditions of Participation and their remaining provisions.
10.3. German substantive law shall apply to the interpretation and implementation of these Terms and Conditions, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
10.4. The exclusive place of jurisdiction is, to the extent permitted by law, Nuremberg.
