Update on Labor Law Regulations in Thailand

The amended provisions of the Labour Protection Act (No. 9) B.E. 2568 (2025) came into effect on 7 December 2025 with relevant changes to employment in Thailand.

  • Parental/Spouse leave: Employees are entitled to 15 days of paid leave to provide assistance to a spouse during childbirth. The leave can be exercised before and after the birth, however, it has to be taken no later than 90 days after the birth of the child. The employee is entitled to 100 % of wages for the 15 days.
  • Childcare/Newborn leave: Female employees may take 15 days of consecutive leave to take care of a newborn child in case the child is suffering from medical complications. Granting of the leave requires a medical certificate from a licensed practitioner and the employer is required to pay 50 % of wages.
  • Maternity Leave Extension: Female employees may take 120 days of maternity leave per pregnancy (previously 98 days). The employer is required to pay 100 % of wages for 60 days.

Statement of Employment on Working Conditions

Companies or employers with 10 employees or more are now required to submit a Statement of Employment Conditions and Working Conditions to the Director-General of the Department of Labour Protection and Welfare within January of every year without request from the authority. As such, the annual submission deadline falls on 31st January. Employers are required to use form Kor. Ror. 11 (note that there was an update to the previous version of the Kor. Ror. 11).
