Challenges and opportunities for our clients

The use of green leases creates attractiveness and a unique selling point on the market. Although the regulatory recommendations now available provide important food for thought, the conclusion of green leases should always be accompanied by a lawyer.

While the so-called "green lease" has been the subject of in-depth discussion in the Anglo-Saxon legal sphere for some time, it has only recently begun to gain ground in Germany. However, despite its growing popularity, there is still no conclusive definition of this type of lease.

The purpose of this type of contract is to encourage the tenant to use the property sustainably  – ecologically, economically and socially – and the landlord to manage it sustainably. In the real estate industry, this can lead to considerable cost reductions and increased attractiveness on the market. The criterion of sustainability also gives companies a special argument to set themselves apart from competitors and rivals. In Germany, there are still no specific regulations that make a rental agree­ment "green". The issue has also not yet been specifically addressed by the legislator.
