Medical criminal law

Medical professionals are increasingly confronted with criminal charges. Although criminal offences against physical integrity are common offences, the new provisions of §§ 299a, 299b StGB established corruption in the health care system as punishable offence.

It is of great importance for the group of health professionals to subject existing practices, cooperations and also contracts to a detailed examination. Of course, the respective law for these professionals plays an important role in the evaluation of their activities.

We expect that in the near future the law enforcement authorities will enormously strengthen the investigative measures in this area.

We provide services in medical criminal law across a range of matters, including:

  • Communication and defence in the event of violation of the medical law;
  • Advice on the Medical Devices Act, the Pharmacy Act and the Pharmacy Operating Regulations;
  • Advice and training in the field of corruption in the health care system;
  • Expert review of cooperation agreements, employment agreements, etc.
