Concessions and grid takeovers

PrintMailRate-it
Thousands of so-called concession contracts where the local authorities grant the energy supply companies the right to use public transport routes have ended in recent years or will end soon. Due to the requirements of the German Federal Network Agency and the Federal Cartel Office for local authorities and energy suppliers, the requirements for a new concession contract have in recent years become significantly more difficult. In the event of a grid takeover after conclusion of a new concession contract, today a number of legal questions still need to be clarified.

Our consulting services for concessions and grid takeovers:
  • Assistance for local authorities and energy suppliers with the award of concessions  (e.g. structuring of the award process, preparation of offers for the conclusion of a concession contract)
  • Representation of local authorities and energy suppliers in regulatory and court proceedings for the award of concessions (e.g. enforcing the right to obtain information, review procedures)
  • Assistance for grid takeovers after conclusion of a new concession contract (e.g. enforcing claims to restitution, elaboration of a grid separation concept, determination of an economic and reasonable purchase price, determination of the revenue cap)
  • Representation of energy suppliers in regulatory and court proceedings for grid takeovers
  • Examination of own concession (preparation of economic feasibility calculations and company valuation estimates, clarification of organisational questions, etc.)
  • Assistance for the implementation of any municipal projects (founding of public utilities and grid companies, etc.)
