Michaela is Associate Partner in Rödl & Partner’s Hamburg investment law team. 

She was admitted to the bar in 2001 and has gained over 20 years of broad professional experience and excellent expertise in banking and banking regulation law, capital markets law and investment law. 

Michaela’s specialization in particular covers advising non-German market participants from both, the EU / EEC as well as from third countries (i.e. Switzerland, the UK or the USA) on an ongoing basis.

Asset manager, UCITS mancos as well as AIFM and MiFID / marketing firms have been working with and relying for years on Michaela’s expert advice and hands-on approach in connection with the offering of their financial products and services as well as any regulatory questions in this respect. 

Literature: Michaela is co-author in: Moritz / Klebeck / Jesch: Frankfurter Kommentar zum Kapitalanlagerecht and expert for the regulations applicable to cross-border services and branch passporting as well as third country market access for AIFM.

  • Admission / notification procedures of investment funds for marketing to (semi-) professional and/or private investors in Germany, including complex BaFin notification procedures such as for non-EU AIF retail marketing, 
  • Advice / set up of regulated MiFID firms as well as marketing entities or BaFin-exempted investment brokers / advisors (§ 34f GewO)
  • Regulatory and commercial law requirements for German branch set ups and  cross-border financial services 
  • Comprehensive legal support for cross-border EU / non-EU management companies and their German offices
  • BaFin authorization and exemption procedures for third country market participants
  • Advice and support re. ongoing compliance obligations vis-à-vis German financial supervisory authorities
